Acceptance of TermsBy accessing or using the website and services of Divine Landscape & Design ("we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you should not use our website or engage our services.2. Services DescriptionDivine Landscape & Design provides landscaping, hardscaping, softscaping, landscape design, epoxy flooring, commercial landscaping, and snow removal services in the Omaha, NE metropolitan area, including Douglas, Sarpy, and Saunders Counties (collectively, the "Services"). The specific scope of work for each project will be described in your written estimate or proposal.3. Estimates & PricingAll estimates and proposals provided by Divine Landscape & Design are valid for thirty (30) calendar days from the date issued, unless otherwise stated in writing. After this period, pricing, availability, and scope of work are subject to change.Estimates are based on the site conditions observed at the time of the visit or as described by the client. Final pricing may vary based on actual site conditions discovered during the project, including but not limited to subsurface conditions, access limitations, required permits, changes requested by the client, or unforeseen circumstances. Any material changes affecting price will be communicated to you for approval before additional work is performed.4. Payment TermsUnless otherwise agreed in writing, a non-refundable deposit of fifty percent (50%) of the total project price is required to schedule work and secure your place on our calendar. No work will be scheduled or commenced until the deposit is received.The remaining balance is due in full upon substantial completion of the project, as reasonably determined by Divine Landscape & Design. Invoices not paid when due may be subject to late fees, finance charges, or collection costs as permitted by applicable law. We reserve the right to suspend work or withhold project completion in the event of non-payment.5. Scheduling & CancellationsProject scheduling is subject to weather, material availability, and other factors beyond our reasonable control. We will make commercially reasonable efforts to meet proposed start and completion dates but do not guarantee specific dates or timelines.If you need to cancel or reschedule your project, you must provide at least forty-eight (48) hours’ notice prior to the scheduled start time. Cancellations with less than 48 hours’ notice may result in forfeiture of part or all of your deposit, at our discretion, to cover mobilization and scheduling costs.Weather-related delays (including but not limited to rain, snow, extreme temperatures, or unsafe site conditions) will be handled at no extra charge to you. In such cases, we will reschedule work for the next available suitable date.6. WarrantyWe stand behind the quality of our work. Divine Landscape & Design provides a one (1) year workmanship warranty on all installations from the date of substantial completion, unless otherwise stated in writing.This warranty covers defects in workmanship only and does not cover damage or failure resulting from misuse, neglect, lack of proper maintenance, normal wear and tear, acts of God, extreme weather events, soil movement, vandalism, or modifications made by others after installation. Plant material is subject to natural conditions and cannot be guaranteed beyond what is expressly stated in writing.To make a warranty claim, you must notify us in writing within the warranty period and provide reasonable access to inspect and remedy the issue. Our obligation under this warranty is limited, at our option, to repair or replacement of the affected work.7. Limitation of LiabilityTo the fullest extent permitted by law, Divine Landscape & Design and its owners, employees, and subcontractors shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or relating to the Services, even if advised of the possibility of such damages.Our total liability for any claim arising out of or relating to the Services, whether in contract, tort, or otherwise, shall be limited to the total amount you paid to Divine Landscape & Design for the specific project giving rise to the claim.You are responsible for notifying us of any underground utilities, sprinkler systems, private lines, or other hidden features on your property prior to the start of work. We are not responsible for damage to unmarked or undisclosed utilities or systems.8. Governing LawThese Terms and any dispute arising out of or relating to the Services shall be governed by and construed in accordance with the laws of the State of Nebraska, without regard to its conflict of laws principles. Any legal action or proceeding shall be brought exclusively in the state or federal courts located in Nebraska, and you consent to the jurisdiction of such courts.9. Changes to These TermsWe may update or modify these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page. Your continued use of our website or Services after any changes indicates your acceptance of the updated Terms.10.
